New update [7/27/2010]
The lawsuit, Hong Chen and Delin Qu vs. Vincent Mar, et al., filed in Ramsey County District Court on November 12, 2009, has been dismissed by the Court. Defendants filed a motion for summary judgment, on which Judge Monahan heard arguments on July 27, 2010. The Judge granted Defendants' motion that same day. A Final Judgment will be issued in the coming weeks. Dear CAAM Members:
As you may have heard, a lawsuit has been filed in state district court against CAAM board Director, Vincent Mar. The suit, styled Hong Chen and Delin Qu v. Vincent C. Mar and [John/Jane] Does 1-12, Case No. 62-CV-09-12113, alleges multiple claims personally by Chen and Qu, who are husband and wife, against Mr. Mar. The allegations contained in the suit are legally and factually without merit and Mr. Mar intends to vigorously defend the lawsuit. If the lawsuit is not expeditiously dismissed, possible counter-claims will be considered.
Mr. Mar is represented in the lawsuit by Jodee McCallum and Michael Patiuk of the St. Paul law firm of Thompson, Coe, Cousins & Irons, L.L.P. Although no other CAAM board members have at this time been named as defendants, Ms. McCallum, Mr. Patiuk, and the law firm also represent the interests of the board of directors relating to this matter.
Recently, it has come to our attention the plaintiffs have begun distributing informal notices and demands for information concerning the lawsuit, which may be misleading or confusing. While you certainly have the option, if you voluntarily choose to do so, to provide information to and cooperate with any party, you have no legal obligation to respond to any informal notice such as the examples attached to this letter, and may choose to ignore them.
